THE SYSTEM OF RISK ANALYSIS IN THE RUSSIAN FEDERATION AT THE ADMISSION OF IMPORTED PRODUCTS OF ANIMAL OR PLANT ORIGIN TO THE DOMESTIC MARKET

Abstract: 

The article is devoted to the legal aspects of risk analysis in the Russian Federation used for admitting imported products of animal or plant origin to the domestic market. The authors assume that the system of risk analysis should be implemented by the Federal Service for Veterinary and Phytosanitary Surveillance (Rosselkhoznadzor). They investigate a number of legal acts concerning risk analysis in the veterinary and phytosanitary sphere and conclude that the regulation of phytosanitary risk analysis is more detailed. In this regard the authors propose to develop the procedure of veterinary risk analysis. Besides that, there is a review of the following stages of risk analysis: risk identification, risk assessment, risk management, risk reporting and audit of risk. The necessity for risk assessment is enshrined at the international level (particularly in the Agreement on the Application of Sanitary and Phytosanitary Measures of 1994). The practice of the WTO dispute settlement body indicates the importance of risk assessment in accordance with international standards and requirements. Due to the fact that risk assessment is an important step in the system of risk analysis when deciding on imported products, the Federal Centre for Animal Health, the All-Russian State Center for Quality and Standardization of Veterinary Drugs and Feed and the All-Russian Plant Quarantine Centre as institutions subordinated to the Rosselkhoznadzor should develop methodological support for risk assessment within their competence. The article also draws attention to the importance of the use of information and analytical systems in risk analysis.
