DISCRETIONARY CHARACTER OF POWERS OF COURT ON CRIMINAL PROCEEDING PRETRIAL INVESTIGATION

The analysis of the criminal procedure legislation allows the author to draw a conclusion on discretionary character of powers of court on criminal proceeding pretrial investigation. In the article legal preconditions of delegation to courts considerable freedom for realization of own discretion or, otherwise, broad discretionary powers of judicial review are considered.
