The article considers the philosophical views by O. Spengler who studied the phenomena of state, state policy, private law, its role and purpose in social life; the cognitive and methodological significance of the property idea in private law philosophy; the origin of law, its differences from legislation; and gave a critical analysis of law and legal thinking.
