PROBLEMS IN THE PREPARATION AND APPLICATION OF ACTS OF PROSECUTORIAL RESPONSE WHEN SUPERVISING THE PRELIMINARY INVESTIGATION BODIES

The article deals with certain problems associated with the preparation and implementation of such acts of prosecutorial response as a request and a decision to send materials to the competent authorities to resolve the issue of criminal prosecution, while supervising the preliminary investigation bodies. The author draws attention to the fallacy of legislator’s decision to deprive the prosecutor of the power to independently initiate a criminal case. It is proposed to return such powers to the prosecutor’s office and to make appropriate amendments to the criminal procedure legislation and the law on the prosecutor’s office.
