AN AGREEMENT ON THE PROTECTION AND PROMOTION OF CAPITAL INVESTMENTS IN RUSSIA: PROBLEMS OF LEGAL REGULATION

Abstract:
The author considers the institute of state investment assistance in a contractual form and, in this context, singles out an agreement on the protection and promotion of investments. It is concluded that there are shortcomings in the current legal regulation of such agreements. These include a number of hard-to-reach conditions of concluding an agreement on the protection and promotion of investments between a private and a public person, which infringe on investor’s rights. In this regard, the author wonders whether it is desirable to amend the Federal Law of April 1, 2020 No. 69-FZ «On the Protection and Promotion of Investments in the Russian Federation».
