Abstract: 

In the article, scientific approaches to the essence of defender’s activities in criminal proceedings, its criminal-law and forensic components are analyzed. The author justifies the necessity to include the activity of a defender into the subject of forensics. This conclusion is formulated on the basis of the compliance of the defender’s goal with the appointment of criminal process and forensics, as well as on the basis of his legal status determining his active role in the investigation of a criminal case. It is assumed that this role can be realized to a greater extent through the participation of the defender in the process of proving. Also the author considers the evidence from the perspective of its procedural form and content, and deduces that it has evidentiary value even before its procedural fixation.
