THE CONCEPT AND CLASSIFICATION OF LEGAL TOOLS OF SOCIAL RISK MANAGEMENT

Based on the modern approach of the general theory of law and branch legal sciences, the concept of legal tools is investigated. The importance of legal tools in the management process, in the field of protection against social risks as well, is assessed. It is proved that the «inclusion» of law in the system of social regulators, that form the principles of social assistance, characterizes the progress of society towards the protection against social risks. The classification of legal tools used for social risk management is carried out. The author proposes a specific (unusual for the mentioned field) criterion of classification of legal tools, which reflects the relation to the social risk of various actors: a man, a state, expert institutions, etc. On this basis the tools of exclusive use and the tools of universal use are distinguished. It is concluded that the variety of legal tools of social risk management allows each subject, involved in the relevant relations, to form and use their specific complexes for the protection against certain types of social risk. Subjects of social risk management, when they select specific legal tools, should try to achieve the optimal combination, balance of different legal tools.
