Abstract:
The article researches J. Habermas’s theory that is one of the most interesting versions of discourses law interpretation. The author touches upon the key issues of this theory: principles of legal discourse, a concept of communicative reason in law, and a concept of deliberative democracy. He analyzes in detail the characteristics of legal system, proposed by J. Habermas, the correlation between law and morale, between politics and law.
