A BALANCE OF PUBLIC AND PRIVATE INTERESTS IN ENSURING NATIONAL SECURITY OF RUSSIA

This article considers topical issues of balancing public and private interests in the current legal policy of Russia while ensuring its national security. The need to ensure an optimal mix of public and private interests is provided by many international human rights treaties and the Russian legislation as well, first of all by the RF Constitution. The authors note that it is rather difficult to determine the nature of such balance and the means to achieve it. The issue of searching for the optimum of public and private interests in the modern state policy related to security matters is still under-researched in both legal science and legal practice. The authors try to answer whether it is possible to find legislative and judicial criteria for balancing public and private interests.
