PROGNOSTIC AND COGNITIVE DECISIONS IN THE RUSSIAN CRIMINAL PROCEDURE

Law enforcement act is a traditional way of the criminal procedure decision (the criminal procedure decision form). The criminal procedure decision essence is newly studied with help of philosophy, psychological decision-making theory, management theory. Moreover, the new concepts of prognostic and cognitive decisions have been constructed, their features are defined. The decision-making process is also analyzed. It is based on information model and situation of uncertainty. Using the concepts of «probability» and «reliability» showed the different decision base of each decision. The aim of the research was to work out an optimal model for the subsequent change of the Russian criminal justice system.
