CATEGORIES «LAW AND ORDER BASES» AND «MORALS» IN THE LIGHT OF DECISIONS OF THE SUPREME BODIES OF JUDICIAL AUTHORITY OF THE RUSSIAN FEDERATION

In the article the categories «law and order bases» and «morals» containing in item 169 of the Civil code of the Russian Federation which owing to their uncertainty created and create possibility to random law enforcment of the given norm are considered. It led to disproportionate restriction of the rights and freedom of subjects of the commercial law, especially from outside tax departments of the Russian Federation. But with acceptance of separate decisions of the supreme bodies of judicial authority of the Russian Federation on the given problem the situation has changed a little.
