HOW COULD THE CHILD ’S RIGHT TO BE RAISED IN A FAMILY IN THE CASE OF DISSOLUTION OF MARRIAGE BE REALIZED UNDER ART. 23 OF THE INTERNATIONAL COVENANT ON CIVIL AND POLITICAL RIGHTS

The article researches the problems of the child’s right to be raised in a family under art. 23 of the International Covenant on Civil and Political Rights. Having analyzed the child’s right to be raised in a family the author underlines the particular importance of the provision of par. 4 of art. 23 that prescribes to provide the necessary protection of any child in the case of dissolution of marriage. Since the provision has raised a number of controversial issues, the author examines the interpretation of problem situations given by the European Court of Human Rights.
