IMPLEMENTATION OF CULTURAL RIGHTS BY THE EXAMPLE OF THE ITALIANLEGISLATION IN THE FIELD OF LINGUISTIC RIGHTS

The authors examine the importance of linguistic rights as a part of cultural human rights, the status of linguistic rights on the universal and European levels. The special attention is paid to the realization of linguistic rights on the example of Italian legislation. Due to its historical development, Italy has always been paying much attention to the language policy. That is why a great part of the article is devoted to the evolution of Italian language legislation since the adoption of the Constitution 1947. The authors put a particular focus on the Constitutional court judgments concerning distribution of competences between the State and the regions.
