LAW AND ECONOMIC AS A METHODOLOGICAL BASE OF CONSTITUTIONAL SCIENCE

The question about methodology of constitutional science is raised. The scope of this science is constantly widening, and now it includes economic relations. Moreover, it could be stated that the whole scope of state interference to economy is regulated by the constitutional law. Obviously, such processes could not leave the science unchanged. It is difficult to regulate economic field having no idea about it. That is why the law and economics is developing in the western science. It is shown that this discipline has two branches: the analysis of non-market transactions and the analysis of market relations. The author argues that it is possible to apply the economic analysis of market relations to the Russian law. In order to check this hypothesis the author tries to solve the definite practical aim – to reveal the basement of governmental interference to economy.
