CORRUPTION RISKS: THE CONCEPT AND IMPORTANCE FOR THE MECHANISM OF FIGHTING CORRUPTION

Abstract: 

This article addresses the matter of defining corruption risks. Having no legal definition, this term is widely used in normative and methodological regulations as well as in scientific literature. As there is no common understanding of corruption risks, it is too hard to exercise anti-corruption measures. Based on the analysis of the concept of risk in the Russian legal system, the author considers corruption risks as a generalized assessment of the likelihood of corruption and its threat to public relations. The article also discusses the importance of corruption risk structures for the implementation of the proportionality principle, according to which anti-corruption procedures must be proportional to the level of corruption risks. The author asserts that this principle is applicable to the whole system of anti-corruption measures and describes the possibilities for its implementation under the anti-corruption legislation.
