Abstract:

The article is devoted to the issue of improving the requirements for mediators in the Russian Federation. The authors state that, despite the legislative consolidation of the mediation procedure in the Arbitration Procedure Code of the Russian Federation and the Civil Procedure Code of the Russian Federation, as well as the positive statistics on the conclusion of settlement agreements, its practical application remains limited. According to the researchers one of the key reasons for this problem is the insufficiently strict and unsystematic requirements for individuals engaged in mediation activities. Special attention is paid to the contradiction between the high complexity of mediation activities, which require in-depth knowledge of law and psychology, and the minimal legal criteria for admission to mediation. Based on a sociological study and analysis of  judicial practice the authors argue for the need to tighten and unify the requirements for mediators

Key words:

mediation, legal proceedings, judicial practice, requirements for mediators, mediator education, professional standard, alternative dispute resolution
