THE CONCEPTS OF ADAPTATION AND INTEGRATION OF MIGRANTS IN THE DOMESTIC AND INTERNATIONAL LEGAL CONTEXT

The significance of adaptation and integration of migrants is multifaceted both for the host society, states, and for the migrants themselves. The article reveals the potential, role, possible threats associated with the adaptation and integration of migrants or the lack thereof through strategic approaches outlined in the concepts of the Russian Federation on various issues and in the UN documents reflecting the understanding reached at the universal level of cooperation between states. The authors identify the international legal foundations for the adaptation and integration of migrants that are absent as treaty obligations of states, but are derived from existing international human rights treaties, covering those in which Russia also participates, and demonstrate the attention of the international community to the issues of adaptation and integration of migrants in connection with the problems of sustainable development and broad, legally non-binding, but agreed approaches to the international legal regulation of migration. The absence of a clear categorical apparatus on the topic under consideration in international law increases the focus on the experience of other states that have included the notions of adaptation and integration of migrants in their legislation (Austria, Finland, Moldova), as well as on the doctrine. The authors draw attention to the frequent identification of the terms under consideration by scientists, which leads to the substitution of concepts and potentially complicates legal regulation. Authors of the present article identify the substantive content of the concepts of adaptation and integration of migrants, and offer their own definitions that take into account interdisciplinary developments, the non-identity of concepts and connection of the concepts with the interests of subjects of different levels.
