The article analyzes the amendment to Part 4 of Art. 67.1 of the Constitution of the Russian Federation from the standpoint of its correlation with the current social security and related legislation, specifically aimed at implementing social policy in relation to orphans and children left without parental care. It provides a description of modern legislative trends called «social constitutionalism» and «child-centrism» and presents the views of some legal scholars on this matter. Attention is paid to the problems of child poverty and social orphanhood, as well as legislative solutions to these problems, the adoption of which is conditioned by the proclamation of Russia as a social state. The legal uncertainty is noted in terms of understanding the constitutional terminology, including that specified in Part 4 of Art. 67.1 of the Constitution of the Russian Federation. An assessment is given to the new vector of social policy, reflected in the updated version of Par. 1 of Art. 123 of the Family Code of the Russian Federation and designated «deinstitutionalization of orphans». A general conclusion is made that the childhood of any child, and a child in a difficult life situation first of all, must be surrounded by comprehensive care from the state. To solve this problem, a radical revision of social policy is necessary, limiting it to the payment of social benefits seems unacceptable, since it disrupts the social balance. In addition, the article states that the priority of caring for the family and the child should come from the state, and it is the state that is primarily obliged to ensure care for the child and guarantee his well-being.
