SOME FEATURES OF THE INTERROGATION OF MEDICAL WORKERS IN CASES OF IATROGENIC CRIMES

Due to the specifics of iatrogenic crimes caused by a special subject and the type of activity carried out, when investigating this category of crimes, difficulties arise related to obtaining reliable information about violations committed by a medical worker in the «doctor – patient» system. One of the most important investigative actions is the interrogation of witnesses, including medical workers. The stage of preparation for the interrogation is of particular importance. At this stage the investigator needs to examine the medical documentation and the expert’s opinion. Due to the specifics of the medical terminology used, it is advisable at this stage to involve a specialist of medicine and health protection. The investigator should also examine the information about the person being questioned. In addition, at the stage of preparation for the interrogation it is necessary to draw up an interrogation plan, specifying in it the circumstances to be clarified, questions and their sequence, a list of evidence and ways of presenting them, tactical techniques. At the same time the subject of the interrogation, as well as the list of questions to be asked to the witness, will differ for each category of medical workers. The development of classifications of medical workers from among the witnesses will allow the investigator to obtain reliable and complete testimony about the circumstances of the adverse outcome of medical care.
