Abstract: 

The author analyzes the possibility and the moment of inheritance of exclusive rights to trademark (service mark) and commercial designation, as well as the conditions for their further realization depending on the heir-owner’s entrepreneurial activity, relying on doctrinal and practical approaches to the problems. The article particularly analyzes the validity of recent changes in the subject composition of the exclusive right to a trademark.
