SOCIAL ASPECTS AND LEGAL INSTRUMENTS FOR REGULATING EXTERNAL LABOR MIGRATION IN RUSSIA IN MODERN CONDITIONS

Improving the effectiveness of measures to regulate the number of foreign workers involved, including based on the real situation on the Russian labor market and trends in its changes, taking into account the needs of the economy of the Russian Federation and the interests of its citizens, is one of the important directions of domestic migration policy. Legal instruments are an integral part of the system of such measures, and the effectiveness of migration policy directly depends of the quality of their legal regulation. Modern political and economic conditions (digital transformation of the sphere of work, conducting a special military operation, external sanctions pressure exerted on Russia and others) determine the need to improve the legal framework for regulating the flows of external labor migration in Russia. The article analyzes the quality of normative regulation of classical mechanisms for regulating the scale of attracting foreign labor provided for in the legislation on the legal status of foreign citizens. Special attention is paid to the development of Russian legislation in terms of determining the legal conditions for the implementation of an organized recruitment of foreign labor and the development of remote employment complicated by a foreign element. Proposals have been formulated to improve Russian migration legislation, labor legislation and in the field of employment promotion.
