ON THE ISSUE OF IMPROVING ART. 264.2 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Based on the analysis of domestic legislation, law enforcement practice and the works of scientists the article examines the sign of the subject of the crime provided for in p. 1 of Art. 264.2 of the Criminal Code of the Russian Federation, which creates conditions for violating the principle of equality of citizens before the law. The author substantiates the position that a person should be brought to criminal responsibility only if all predicate offenses are recorded by an authorized police officer.
