Abstract:

The article deals with issues related to the tactics of verbal investigative actions with members of stable armed groups (gangs). It seems problematic that in judicial practice there are cases when in the course of a criminal case the court excludes the qualifying feature «organized group» from the accusation of the defendants. The reason for this, as a rule, is the lack of a sufficient evidence base provided by the preliminary investigation bodies to the court, allowing to agree with the proposed qualification of the criminal act in full. In order to effectively use all the theoretical and practical provisions of organizational measures, the investigator must possess all the subtleties and knowledge of modern criminology. It must be remembered that each investigative action has its own specifics, especially when investigating crimes committed in a group. The article describes in detail the features of the use of some tactical and forensic techniques in the process of interrogation in the investigation of crimes committed by members of stable armed groups (gangs). The issues of the use of tactical operations and combinations that contribute to obtaining truthful testimony on the merits of a criminal case from gang members are analyzed.
