CURRENT ISSUES IN THE FORMATION OF COOPERATIVE LEGISLATION IN RUSSIA (SECOND HALF OF THE XIX – BEGINNING OF THE XX CENTURY): A RETROSPECTIVE STUDY

The article reveals the problems associated with the formation of Russian cooperative legislation, identifies the main stages in its development, determining the specific functioning of the cooperative system. The nature and degree of administrative impact of various public authorities on the formation of the cooperative movement in Russia are determined. The retrospective analysis reveals trends in the development of cooperative movement, demonstrates the inconsistency and ambiguity in the implementation of state policy in the early stages of its formation, due to the desire of authorities to ensure control and supervision administration in this area, thereby preventing its opposition-democratic politicization. As a result of the study the author concludes that from the beginning the relationship of cooperation with the state power was permeated by the struggle for its existence, and the development of the cooperative movement took place in the context of the opposition of administrativeconservative and liberal-democratic vectors. The first was based on the establishment of almost total control and centralization of the state management system of cooperation. The second advocated democratic trends in the development of cooperation, including the principles of voluntariness, equality, self-government, self-financing, quota order of education, etc. The author believes that the results of the study are of practical, methodological importance for public authorities and their officials, ensure the avoidance of errors of the past in the modern mechanism of normative-legal regulation of the cooperative sphere.
