TO THE DISCUSSION ON THE NEED TO INCLUDE ELECTION COMMISSIONS IN THE LIST OF OBJECTS OF PROSECUTORIAL SUPERVISION
Article:
The article considers the possibility to update the list of objects of prosecutorial supervision and to align it with actual social relations. Doctrinal positions on classifying electoral commissions as objects of prosecutorial supervision are considered. It is noted that the absence of election commissions of various levels in the list of legally defined objects of prosecutorial supervision does not mean that prosecutors cannot exercise supervision over legal acts adopted by these bodies and actions (inaction) of officials, given that the activities of these entities is precisely an object of supervision activities of the prosecutor’s office. The author proposes to divide the objects subject to prosecutorial supervision into three groups: public authorities, private entities and entities with a special public law status that have the power. According to the author, such a division can contribute to properly determining the priorities of prosecutorial supervision and establishing the subject and limits of its implementation.
