THE FORMAL APPROACH TO EVALUATION OF EMPLOYMENT AS A FACTOR OF INEFFICIENCY OF MEASURES TO PROTECT AGAINST UNEMPLOYMENT

Unemployment is the most dangerous problem for society that reduces the quality of life of the population and serves as the cause of the economic crisis in the state. That is why the fight against unemployment is one of the key directions of state policy. The effectiveness of this policy largely depends on the effectiveness of legal regulation in the field of employment. It is possible to achieve the goals of reducing the unemployment rate, ensuring high-quality protection of the unemployed from the adverse consequences of the loss of income-generating activities, and establishing adequate measures to promote employment only when protection measures and criteria for selecting citizens in need of their provision are correctly defined. The article examines the norms of employment legislation defining the circle of persons who can be recognized as unemployed, as well as the practice of applying these norms. Such an approach makes it possible to identify norms, the application of which, on the basis of their literal interpretation, allows us to classify as employed citizens, who do not have the right to be recognized as unemployed, those people, who in fact are in need of state support measures. The above said gives grounds to raise the question of the need to revise the categories of «employed citizen» and «unemployed citizen», as well as the category of «employment» in general. The preservation of the current legal regulation of employment of the population will lead to a restriction of the right of a significant part of citizens to receive state support.
