ADDITIONAL GUARANTEES IN THE SPHERE OF LABOUR AND EMPLOYMENT OF ORPHANS AND PERSONS EQUATED TO THEM

The article analyses the legislative regulation of additional guarantees of the right to work and social protection from unemployment established for orphans left without parental care and persons from among them. The issues of employment and dismissal of these persons, payment of unemployment benefits to them are studied. The author reveals the presence of duplicating and referential norms in the legislation regulating relations in the field of social protection of orphans, which does not allow classifying the guarantees established for them as additional ones. Besides that, the issue of the unequal position of persons who have lost their parents during the period of study, and orphans left without parental care and persons from among them is touched upon. The author concludes that it is necessary to amend the legislation to eliminate the identified defects, and proposes to extend additional guarantees in the field of employment and social protection from unemployment to persons, who lost their parents during the period of study.
