PROBLEMS OF LEGAL REGULATION OF THE ACTIVITIES OF SUBJECTS OF PUBLIC CONTROL IN THE FIELD OF STATE AND MUNICIPAL PROCUREMENT

Public control in the field of state and municipal procurement is the activity of citizens and public associations aimed at developing the contract system and identifying violations of the law. The author points out certain shortcomings of the Federal Law of April 5, 2013 No. 44-FZ «On the contract system in the field of procurement of goods, works, services to meet state and municipal needs». In particular, this law does not establish an exhaustive list of subjects of public control in the field of state and municipal procurement and does not provide requirements for their qualifications; in addition, there is a contradiction regarding time limits of the consideration of complaints from participants in state and municipal procurement and subjects of public control.
