TO THE LEGAL PERSONALITY OF TRANSNATIONAL CORPORATIONS

Currently, the doctrine does not have a consensus on the legal personality of transnational corporations (TNCs), and there is also no legally binding international treaty establishing their status as a subject of international law. These factors hamper the effective regulation of their activities under international law. The author discusses modern concepts of the legal personality of TNCs and also analyses the positions of domestic and Western scholars to determine the legal status of TNCs in international public law. The author comes to the conclusion that today the tendency to recognize partial international legal personality for TNCs prevails, however, in the near future this situation may change and TNCs may become full-fledged subjects of international law.
