Article:
The category of «non-working days», which was used by the state authorities to prevent the development of the new coronavirus disease COVID-19 pandemic on the territory of Russia, is new for labour law. The author highlights its distinctive features and also makes a distinction between this category and the types of rest time provided for by labour legislation. The complex nature of the category of «non-working days» is substantiated, since it is regulated by sanitary legislation, legislation in the field of protection of the population and territories from emergencies and labour legislation. It is concluded that, from the position of labour law, the period of non-working days should be considered as a special case of suspension of employees from work. Suggestions for improving Russian labour legislation are formulated.
