THE ISSUE OF CONFORMITY BETWEEN THE ILO HOLIDAYS WITH PAY CONVENTION 1970 (No. 132) AND THE LABOUR CODE OF THE RUSSIAN FEDERATION

The article studies the conformity between provisions of the ILO Holidays with Pay Convention (revised) 1970 (No. 132) and provisions of the Labour Code of the Russian Federation governing holidays with pay. The author discovers unresolved problems of the relations between these sources of labour law and proposes the efficient solutions of them. Particularly, the author puts forward the original method for determining duration of parts of a holiday in case of its division, which, on the one hand, provides employer and employee with a freedom of contract and, on the other hand, protects employee from abuse.
