The author examines the doctrine and certain provisions of international law on the legal nature of a state territory. She proves that the territory is an international criterion of a state in terms of international law by taking into account the concepts developed by domestic theory of state and law as well as by Roman law. She reveals the consequences of disappearance of the national territory for the international legal status of a state and proposes the ways to solve the «disappearing» states problem.
