CONTRACTUAL THEORY AS THE INFORMATION-QUANTUM RESULT OF CONSTITUTION OF LEGAL AWARENESS CONDITIONS OF HOMO JURIDICUS

The article reveals features of the postnonclassical type of the scientific rationality in the light of which investigation of the state, viewed as the stages of development of the society – the ethnos, the people and the nation, is conducted. Meanwhile, the above-mentioned socio-historical organisms are constituted as a result of decomposition of the «society» (the higher «Self») quantum quasi-system superposition. Moreover, according to the author, individuals have concluded four types of contracts for the history of humankind being localizations of four quantum states. These are legal awareness qualities reflected in treatises of representatives of different eras. It’s stated that, at a definite development stage of the legal awareness of the society, the mental clusters present in the subtle space increase their energy potential to the extent that they start having a correspondent impact on the course of the historical and cultural development of the people. The quantum condition of the legal awareness of the nation, in which the legal reservoir of spatial thoughts not only influences the behavior of individuals in the socium but also controls it, is called the nation and represents the fourth type of a social contract.
