The article dwells upon an origin of the theory of state and law in the Russian jurisprudence, it is analysed pre-revolutionary and Soviet stages in its formation and concluded that both a law and a state began studying in one science artificially, without any pre-conditions in a development of the legal science and needs of a research practice.
