PERIODS IN DEVELOPMENT OF THE SPECIALIZED PROTECTING ORGANS OF THE CONSTITUTION IN THE REPUBLIC OF KAZAKHSTAN

Abstract: 

This article aims at analyzing the origins of formation of the protecting organ of the Constitution in the Republic of Kazakhstan. There have been defined four periods since the USSR times. The first period was marked by a formal performance of the Constitution protection executed by supreme power organs of the union republic under excluding the separation of powers conditions. The first period (from the 20s up to the 80s of the XX c.) was characterized by the lack of constitutional control or supervision. The second period (from 1988 up to 1991) was characterized by an attempt to establish Constitutional Supervision Committee similar to the corresponding institute of the union level. During the third period (from 1991 up to 1995) Constitutional Court of the Kazakhstan republic was established that demonstrated declared by the state separation of powers principle. During the fourth period Constitutional Council of Kazakhstan was established which has been functioning since 1995 up to now.
