THE SYSTEM OF CRIMINAL PUNISHMENT AS A CONDITION AND LIMITS FOR INDIVIDUALIZATION OF PUNISHMENT

The author proves that imposition of a particular type of punishment and then its length (amount) is a central part of the institute of imposition of punishment. Implementation of a principle of punishment individualization is regarded as a process consisting of several stages.The author concludes that the punishment system, established by law, acts as a key condition for individualization of punishment and, at the same time, sets its limits.
