PRINCIPLES OF THE JUDICIAL CORPS FORMATION

The article analyses the international and European approaches to the formulation of the principles of the judicial corps formation. The list of the basic principles of the judicial corps formation and the principles underlying certain stages of this process is substantiated and their content is disclosed. It is noted that, in the Russian legislation, the principles of the judicial corps formation are contained only in the norms concerning the activity of the qualification collegiums of judges. It is concluded that the principles of the judicial corps formation are based on the principles of the organization and activity of the judicial power and reflect the peculiarities of the legal status of the judge, the social and legal purpose of the judicial activity and the need to maintain the authority of the judicial power.
