Abstract: 

The article reveals the problems of the prosecutor’s supervision over the observance of the Russian Constitution, the rights and freedoms of man and citizen by executive authorities, their territorial subdivisions, public authorities of the subjects of the Russian Federation, local self-government authorities, and their officials in the proceedings on administrative offenses, as well as over the execution of laws on administrative offenses operating in the territory of Russia, which have emerged after the amendments to the Federal law «On the Prosecutor’s office of the Russian Federation». The article also discusses the conflicts between the laws governing these legal relations and suggests ways to eliminate them. In particular, it is proposed to allocate a separate subject of the prosecutor’s supervision in the Federal law «On the Prosecutor’s office of the Russian Federation» and to consolidate the appropriate prosecutor’s powers to use systematically the means to identify violations of laws, human and civil rights and freedoms committed by the above-mentioned authorities and officials in the proceedings on administrative offenses, regardless of the information about the violation of the law submitted to the prosecutor’s office, as well as the powers (including «compensatory» ones) to apply the appropriate means to respond to violations of laws, rights and freedoms of man and citizen.
