Abstract: 

The article covers such factors of the establishment of an ombudsman institution in the Russian Federation as the national human rights doctrine and the history of the establishment and functioning of current human rights institutions. It highlights the main doctrinal approaches to identify the content of human right to entrepreneurship. It also concludes that there is a prevalence of «paternalistic» approach to human rights protection in Russia. The article also provides a comparative analysis of national human rights institutions in the entrepreneurial field. Special attention is paid to the Russian model of human rights institutions including specialized ombudsmen. The author finds out that the business-ombudsman in Russia has a composite nature which combines features of both state and public institution.
